Please read before signing, as this constitutes the agreement between you and St. Luke’s United Methodist Church (“SLUMC”) regarding your working relationship as a volunteer.
I, the undersigned acknowledge and state the following:
I have chosen to travel to perform clean-up/construction work designed to repair or replace housing affected by natural or manmade disasters. I understand that this work entails a risk of physical injury and often involves hard physical labor, heavy lifting, and other strenuous activity, and that some activities may take place on ladders and building framing other than ground level. I certify that I am in good health and physically able to perform this type of work. I agree that if I suspect any conditions to be unsafe, I will immediately discontinue participation in the affected area or activity and alert a TRT representative.
I understand that I am engaging in this project at my own risk. I assume all risk and responsibility for any damage to my property and any personal injury which I may sustain while involved in this project, ranging from minor to serious and the possibility of permanent disability, paralysis or death which may be caused by my own actions or inactions, the actions or inactions of others participating in the activities, the weather and other conditions in which the activities take place, and related medical costs and expenses.
If my supervising organization arranges accommodations, I understand that they are not responsible or liable for my personal effects and property and that they will not provide lock up or security for any items. I will hold them harmless in the event of theft or for loss resulting from any source or cause. I further understand that I am to abide by whatever rules and regulations may be in effect for the accommodations at the time.
By my signature, for myself, my estate and my heirs, I release, discharge, indemnify and forever hold SLUMC, together with its officers, directors, agents, servants, representatives and employees (the “Releasees”), harmless from any and all liabilities, claims, demands, losses, causes of action, and attorneys’ fees arising from my participation in this project, or the travel or lodging associated therewith, including any damages which may be caused by their negligence and regardless of whether such liability arises in tort, contract, strict liability or otherwise. I acknowledge and understand that I have had the opportunity to discuss this Release with an attorney of my choosing. I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid under the laws of my state of residence or the state in which the activities are conducted, the balance, notwithstanding, shall continue in full force and effect. I understand that if, despite this Participant General Liability Release, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless such Releasee from any loss, liability, damage, attorneys’ fees, or cost which may incur as a result of such claim.
I understand that while conducting this project, SLUMC may make photographic, video, and/or audio recordings of its activities and participants. I grant and convey to SLUMC the right to use such recordings, which may include me, in advertising or promotional materials for SLUMC.
